Welcome to Sail, a group travel coordination platform designed to help organizers plan trips and keep travelers informed. By using our website (sailvacations.app) and mobile applications, you agree to the following Terms of Service.

1. Acceptance of Terms

By accessing or using Sail, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree with any part of these terms, you may not use our services.

2. Eligibility

You must be at least 13 years old to use Sail. If you are under 18, you must have parental or guardian consent. By using Sail, you confirm that you meet these requirements.

3. User Accounts

Accounts are required for trip organizers only. Travelers added to a trip by an organizer do not need to create an account.

As an account holder, you are responsible for maintaining the security of your credentials and for all activity that occurs under your account. You agree not to share your login credentials with others. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Organizer Responsibilities

Trip organizers are responsible for the accuracy of trip information they create and share through Sail. Organizers are also responsible for ensuring they have the consent of travelers to add them to a trip and to send them SMS messages via the Sail platform.

By adding a traveler's phone number to a trip, you represent that you have a legitimate, non-commercial relationship with that individual and that they have consented to receive SMS messages related to the trip.

5. User-Generated Content

You retain ownership of any content you create or share on Sail, including trip itineraries, notes, and uploaded documents. By submitting content to Sail, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for the purpose of operating and improving the platform.

You agree not to post content that is unlawful, offensive, or that infringes on the rights of others.

6. Prohibited Activities

When using Sail, you agree not to:

Use the service for any illegal purpose or in violation of any applicable law or regulation.

Add travelers to a trip without their knowledge or consent.

Use Sail's messaging infrastructure to send unsolicited commercial messages, spam, or misleading content.

Attempt to gain unauthorized access to other users' accounts or Sail's systems.

Reverse engineer, scrape, or otherwise interfere with Sail's platform or infrastructure.

7. Third-Party Links and Services

Sail may integrate with or link to third-party websites or services. We do not endorse and are not responsible for the content, accuracy, or practices of any third-party services. Your use of third-party services is subject to their respective terms and policies.

8. SMS and Messaging

Sail sends text messages (SMS/MMS) to trip participants for purposes including trip invitations, itinerary updates, polls, task assignments, and activity notifications.

SMS opt-in disclosure

Program. Messages are sent only for trip coordination on Sail. They are not sent for unrelated marketing.

Voluntary. Receiving ongoing SMS is optional. You can use the Sail web app for your trip without opting in to SMS, and opting in is never required to use the Sail platform or access trip information.

Not a condition of purchase. Agreeing to receive SMS is not required as a condition of purchasing goods or services from Sail, where applicable.

Consent. Travelers receive one initial invitation SMS. No further messages are sent unless the traveler opts in, for example by replying YES to an invitation message or by providing consent through the Sail web app (such as when joining a trip) where that option is presented. Opting in is never required to access trip information.

Opt-out: Reply STOP at any time to stop receiving messages. Reply HELP for support information. You may also contact us at support@sailvacations.app to manage messaging preferences.

Message frequency: Varies based on trip activity, including invitations, updates, polls, and task assignments.

Rates: Standard message and data rates may apply depending on your carrier.

Our SMS messaging is powered by Twilio. Twilio's terms and privacy policy apply to the delivery of messages: https://www.twilio.com/legal/tos and https://www.twilio.com/legal/privacy.

9. Subscription and Payments

Sail operates on a freemium model. Core features are available at no cost. Premium features, including advanced tour operator functionality, white-labeling, expanded group capacity, and analytics, are available through paid tiers.

All payments are non-refundable unless otherwise required by applicable law. Pricing and feature availability may be updated at our discretion with reasonable prior notice to affected subscribers.

10. Termination

We reserve the right to suspend or terminate your access to Sail at any time for violation of these Terms of Service, without prior notice where we determine it is warranted. You may delete your account at any time through your account settings. Termination does not affect any rights or obligations that arose prior to termination.

11. Disclaimer of Warranties

Sail is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, the accuracy of platform content, or the reliability of SMS delivery, which may be affected by carrier and network conditions outside our control.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Sail and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the service, including but not limited to damages resulting from missed trip communications, SMS delivery failures, or data loss.

13. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes by email or through the platform. Continued use of Sail after changes are posted constitutes your acceptance of the revised terms. The effective date at the top of this document reflects the most recent revision.
